Terms of Service

1. Definitions

• Account — your registered identity and associated configuration.
• API Key — a secret credential used to authenticate programmatic requests.
• Connected Mailbox — a third-party email account (e.g. Gmail, Zoho) you authorize us to send and receive mail through using SMTP/IMAP credentials you provide.
• Recipient — any person or address to whom email is sent through the Services.
• Content — message subjects, bodies, attachments, lists, and data you submit.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for all activity under your Account and API Keys, for keeping them confidential, and for any consequences of their loss or unauthorized use. Notify us immediately of any suspected compromise. We may refuse, suspend, or terminate accounts at our discretion, including for suspected abuse.

3. The Services

3.1 EdgeMailAPI

Sends transactional and bulk email on your behalf from domains you are authorized to use, via Cloudflare Email Service, with API-key authentication, subscriber-list management, and AI-assisted composition.

3.2 EdgeReach

Sends outbound email through your own Connected Mailbox using credentials you supply, supports multi-step sequences, AI personalization, reply/bounce detection, and an opt-in mutual warm-up pool. We do not host your mailbox; deliverability, sending limits, and reputation are governed by your mailbox provider and your own conduct.

4. Acceptable Use Policy (AUP)

You agree NOT to use the Services to:

• Send unsolicited bulk email ("spam") or messages to recipients who have not consented or with whom you lack a legitimate, lawful basis to communicate;
• Use purchased, rented, scraped, or harvested address lists;
• Send deceptive headers, false "From" identities, or misleading subject lines;
• Send unlawful, fraudulent, phishing, malware, harassing, defamatory, infringing, or sexually exploitative content;
• Evade spam filters, rotate identities to disguise volume in bad faith, or circumvent any provider's sending limits or terms;
• Violate CAN-SPAM (US), CASL (Canada), GDPR/ePrivacy (EU/UK), or any applicable anti-spam, privacy, or marketing law;
• Fail to honor opt-out/unsubscribe requests promptly (within 24 hours), or omit a functioning unsubscribe mechanism and valid physical postal address where required;
• Resell or provide the Services to third parties without our written authorization.

5. Connected Mailboxes & credentials (EdgeReach)

• You represent that you own or are authorized to use each Connected Mailbox and its credentials.
• Credentials are encrypted at rest (AES-GCM) and used solely to send and read mail on your behalf to operate the features you enable.
• You are responsible for compliance with your mailbox provider's terms (e.g. Google, Microsoft). Some providers prohibit or limit automated/bulk sending; violations are between you and that provider.
• Mail sent via a Connected Mailbox originates from your account and reputation, not ours. We are not your email provider.
• You may disconnect a mailbox at any time, which deletes its stored credentials.

6. Warm-up pool (EdgeReach)

The warm-up pool is strictly opt-in. By opting a mailbox in, you consent to that mailbox automatically sending and receiving benign, system-generated emails to and from other consenting members, and performing engagement actions (opening, replying, moving from spam). Warm-up traffic counts toward your provider's sending limits. You may leave at any time. We make no guarantee that warm-up improves deliverability; mailbox providers may detect and penalize automated warm-up, and effectiveness depends on factors outside our control.

7. AI features

AI-generated drafts and personalization are provided "as is." You are solely responsible for reviewing and approving all content before it is sent and for its accuracy, legality, and appropriateness. AI output may contain errors. We do not warrant that AI content complies with any law.

8. Fees, billing, renewals & cancellation

• Paid plans are billed in advance on a recurring monthly basis via our payment processor (Stripe). By subscribing you authorize recurring charges until you cancel.
• Plans include monthly usage allowances; exceeding them may result in blocked sends or required upgrade.
• Cancellation: you may cancel anytime via the in-app billing portal. Cancellation stops future renewals; access continues until the end of the current paid period.
• Refunds: fees are non-refundable except where required by law. We do not provide pro-rated refunds for partial periods.
• We may change pricing with at least 30 days' notice; changes apply at your next renewal.
• Taxes are your responsibility where applicable.

9. Customer responsibilities & indemnification

You are solely responsible for your Content, your recipient lists, your legal basis for contacting recipients, and your compliance with all applicable laws. You agree to indemnify, defend, and hold us harmless from any claims, damages, fines, or expenses (including reasonable legal fees) arising from your Content, your use of the Services, your violation of these Terms or any law, or your breach of any third party's rights.

10. Service availability & modifications

The Services are provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation, specific deliverability or inbox placement, or that any message will be delivered. Beta features (including features built on third-party beta services such as Cloudflare Email Service) may change or be withdrawn. We may modify or discontinue features at any time.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING DELIVERABILITY, REPUTATION, OR BUSINESS RESULTS. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE SECURE, TIMELY, OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR DELIVERABILITY, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

13. Suspension & termination

We may suspend or terminate your access immediately, without notice, for actual or suspected violation of these Terms or the AUP, for abuse signals (high spam/bounce rates), for non-payment, or to protect the Services, other customers, or third parties. Upon termination your right to use the Services ends; we may delete your data after a reasonable period. Sections that by their nature should survive (including 9, 11, 12, 14) survive termination.

14. Governing law & disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. The exclusive venue for disputes is the state and federal courts located in Texas, and you consent to their jurisdiction. You and we agree to first attempt to resolve disputes informally by contacting us.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and, where required, notified to you. Continued use after changes constitutes acceptance.
